1. Acceptance of Terms
By accessing or using the Immupure website, or by purchasing Immupure products through the Site, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these Terms, you may not access or use the Site or purchase Products. Immupure may update or modify these Terms at any time, and such changes will be effective upon posting. Your continued use of the Site or purchase of Products through the Site constitutes acceptance of the revised Terms. For purposes of these Terms, “Site” refers to the Immupure website, and “Products” refers to Immupure-branded skincare products made available through the Site.
2. Eligibility and Accounts
You must be at least 16 years of age to use this Site. The Site is not directed to individuals under 16, and Immupure does not knowingly collect personal information from anyone under this age. If we become aware that such information has been provided, we will promptly delete it. To purchase products, you must be at least 18 years old or the age of majority in your jurisdiction. By placing an order, you represent and warrant that you meet this requirement. If you create an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Immupure reserves the right to suspend or terminate accounts suspected of fraud, abuse, or violation of these Terms.
3. Product Information & Use
Immupure products are cosmetic in nature and are not medical treatments. They are not intended to diagnose, treat, cure, or prevent any disease. Information on the Site is provided for general informational purposes only and is not a substitute for professional medical advice. Results vary by individual. Perform a patch test before first use and discontinue if irritation occurs. Consult a physician prior to use if you are pregnant, nursing, have sensitive skin, have a known medical condition, or are under medical care.
Product packaging, jar design, and labeling may be updated periodically, and the product you receive may differ slightly from images shown on the Site. We may also update ingredients from time to time to improve formulations or comply with regulations.
4. Orders, Pricing, Payments, and Taxes
All orders are subject to acceptance by Immupure. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, resale intent, or product unavailability. Prices are listed in U.S. dollars and may change without notice. We may correct errors or inaccuracies, including after an order is placed, and we are not responsible for typographical errors. We reserve the right to limit quantities or discontinue any product at any time. Immupure does not guarantee the availability of any product, and products may be out of stock or discontinued. We are not liable for product unavailability.
Payments
Payment is processed through third-party providers; their terms apply, and we are not responsible for errors or breaches by payment processors. You authorize us to charge your selected payment method for the total order amount, including applicable taxes, shipping, and fees. You are responsible for all taxes, duties, and similar charges that may apply to your purchase.
All direct payment gateways offered through Shopify adhere to the standards set by PCI-DSS, as managed by the PCI Security Standards Council (a joint effort of Visa, Mastercard, American Express, and Discover). Immupure does not store or have access to your full payment card details, and all transactions are processed through Shopify’s PCI-DSS compliant payment infrastructure.
5. Shipping, Delivery, and Risk of Loss
Shipping options and estimated timelines are shown at checkout; delivery dates are estimates and are not guaranteed. All items purchased from Immupure are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. You are responsible for providing an accurate shipping address and for securing delivery at that address. International shipments may be subject to customs duties, fees, and clearance procedures that can cause delays.
6. Returns & Refunds
Please refer to Immupure’s Shipping & Returns Policy for details. For health and safety reasons, opened or used products are not eligible for return unless defective or shipped in error. Return shipping costs are the responsibility of the customer unless otherwise specified. We reserve the right to inspect returns and to deny refunds that do not comply with the policy.
7. Third-Party Retailers
Purchases of Immupure products made through authorized third-party retailers are subject to the terms and policies of those retailers. Immupure is not responsible for the practices, policies, or transactions of any third-party retailer. These Terms apply solely to your use of the Site and to purchases made directly through the Site.
8. Promotions, Offers, and Limitations
Promotional offers may not be combined and are not valid on prior purchases. We may limit quantities per person, per household, or per order and may cancel or refuse orders that appear to be placed by resellers, distributors, or dealers. Promotions are subject to change or termination at any time without notice.
9. User Content; Reviews and Submissions
By submitting reviews, comments, photos, or other content, you grant Immupure a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such content in any media for lawful purposes, including marketing. You represent that your submissions are accurate and do not infringe any third-party rights or contain unlawful, defamatory, obscene, or otherwise objectionable material. We may remove content at any time in our discretion.
10. User Responsibilities & Prohibited Conduct
You agree not to use the Site for unlawful, fraudulent, or abusive purposes; post or transmit viruses, malware, or other harmful code; interfere with or disrupt the Site’s operation; attempt to gain unauthorized access to any portion of the Site, accounts, or systems; harvest data, scrape content, or reverse engineer any portion of the Site; or resell Immupure products without our written authorization. Immupure may take any action it deems appropriate for violations, including suspension or termination of access.
11. Intellectual Property
All content on the Site, including text, graphics, photographs, logos, product names, designs, and software, is owned by Immupure or its licensors and is protected by intellectual property laws. Subject to these Terms, Immupure grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other rights are granted. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Site content without our prior written permission.
12. Affiliate and Influencer Use
By participating in Immupure’s affiliate or influencer programs, you agree to comply with all applicable laws, these Terms, and program rules. You may only use Immupure’s trademarks, logos, product images, and other brand assets as expressly permitted by Immupure. Affiliates and influencers are solely responsible for the content they create or distribute, the accuracy of any claims made about Immupure products, and for proper disclosures required under applicable laws (including FTC guidelines). You must not make medical or therapeutic claims about Immupure products. You may share personal testimonials and experiences, provided these are truthful, not misleading, and consistent with cosmetic claims. Immupure reserves the right to terminate participation, revoke access to brand assets, or take other appropriate measures if these Terms or program rules are violated.
13. Health & Safety Disclaimer
Skin chemistry varies. Immupure is not responsible for adverse reactions due to individual allergies, sensitivities, pre-existing conditions, or misuse, including use with incompatible products or failure to follow directions. Discontinue use and consult a physician if irritation occurs.
14. No Warranties
THE SITE, ITS CONTENT, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, IMMUPURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DEFECTS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMMUPURE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. IN NO EVENT WILL IMMUPURE’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify and hold Immupure, including its officers, directors, employees, and agents harmless from any claims, damages, or expenses (including reasonable legal fees) that may result from your violation of these Terms, infringement of another’s rights, or unlawful use of our site or products.
17. Third-Party Links and Services
The Site may contain links to third-party websites or services. These are provided for convenience only. Immupure does not endorse, control, or assume responsibility for third-party content, policies, practices, products, or services. Accessing third-party sites is at your own risk.
18. Governing Law; Dispute Resolution
These Terms and any dispute between you and Immupure are governed by the laws of the State of Delaware without regard to conflict-of-law principles. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or products shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its applicable rules. The arbitration shall be conducted in English in Wilmington, Delaware, by a single arbitrator, and the award may be entered in any court of competent jurisdiction. You and Immupure agree to arbitrate disputes on an individual basis only, and not as a class, collective, or representative action. Nothing in this section prevents either party from seeking injunctive or other equitable relief to protect intellectual property or confidential information, or from pursuing a claim in small claims court where available.
19. Force Majeure
Immupure shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, epidemics, acts of government, war, terrorism, labor disputes, failures of suppliers or carriers, power or Internet outages, or other events of a similar nature.
20. Changes to the Site
We may modify, suspend, or discontinue any part of the Site at any time without notice. We are not liable for any modification, suspension, or discontinuance.
21. Changes to Terms
We may revise these Terms at any time by updating this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
22. Electronic Communications; Notices
You consent to receive communications from us electronically and agree that all notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Legal notices to Immupure should be sent via email to help@immupure.com.
23. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. You may not assign these Terms without our prior written consent; we may assign them without restriction. No waiver of any term is a continuing waiver. These Terms constitute the entire agreement between you and Immupure regarding the Site and supersede all prior or contemporaneous communications on that subject.
